A federal judge in New York has granted Cumulus Media’s motion for a preliminary injunction against Nielsen, blocking enforcement of Nielsen’s Network Policy in contract negotiations and establishing a competitive pricing benchmark for nationwide radio ratings sold as a standalone product.
U.S. District Judge Jeannette Vargas ruled that Cumulus demonstrated irreparable harm and showed a “strong likelihood” of success on the merits of its monopoly-tying claims included in an antitrust lawsuit against the ratings company. “Cumulus has a strong likelihood of succeeding on the merits in this case, that the balance of hardships weighs toward Cumulus, and that the public interest weighs in favor of a preliminary injunction,” Vargas writes in the two-page order.
